e-Monitoring Services respects your privacy and has created this privacy statement ("Statement") in order to demonstrate our commitment to customer privacy. This policy governs web sites owned and operated by e-Monitoring Services including www.e-Monitoring Services.com (the Site). We have established this Statement as a means to communicate our information gathering and dissemination practices to our customers and visitors. This online privacy policy describes how we use, disclose and protect personal information that you share with us. "Personal information" is information that enables us to identify you, such as your name and e-mail address. By using this Site, you agree to this Privacy Policy. If you do not agree to this Privacy Policy, please do not use the Site.

Introduction

The Service is a personal health management service that allows you to set and send medication reminders, gather, edit, and store medication records, manage contacts and website links, track health statistics, and keep a health journal. You can also share your health information with family, friends, and health care professionals. An account allows you to create and manage your own health records, and as an invited user to another account, you can help manage the accounts of family, friends, or patients. You choose what information to put in your records. Examples of the types of information you can store in a record include:
  • Medication and event reminders
  • Measurements such as blood glucose, weight and blood pressure
  • Contact information and notes
  • Medical history
  • Medications
  • Website links
  • Journal entries
  • Wellness scores
  • Health profile

Information Collection and Use

The Service asks you to enter an identifier and password to sign in. We require customers who register to use the services offered on our Sites (collectively, the "Service") to give us contact information, such as their name, company name, address, phone number, and e-mail address, and financial qualification and billing information, such as billing name and address, and checking account information or credit card number.

We will use the e-mail address you provide when you create your account to send you an e-mail requesting that you validate your email address, to include in sharing invitations you send through the Service and to send you Service notifications, such as e-mail notification that information is available to add to your account. This e-mail address can be changed at any time from the Profile page in your account.

e-Monitoring Services uses the information that we collect to set up the Service for customers. We may also use the information to contact customers to discuss the Service that we provide, and to send information regarding our company, service or partners, such as promotions and events. Customers can opt out of being contacted by us, or receiving such information from us, at any time by clicking here and submitting their email.

All financial and billing information that we collect through the Site is used solely to check the qualifications of prospective customers and to bill for the Service. This billing information is not used by RememberItNow! for marketing or promotional purposes. RememberItNow! uses a third-party intermediary to manage the credit card processing. This intermediary is solely a link in the distribution chain, and is not permitted to store, retain, or use the information provided, except for the sole purpose of credit card processing.

Customers of the Service will be using the Site to host data and information ("Data"). e-Monitoring Services will not review, share, distribute, print, or reference any such Data except as provided in the e-Monitoring Services Terms of Service ", or as may be required by law. Individual records may at times be viewed or accessed only for the purpose of resolving a problem, support issue, or suspected violation of the Terms of Service, AUP, or as may be required by law. Of course, customers are responsible for maintaining the confidentiality and security of their user registration and password.

e-Monitoring Services may also collect certain information from visitors to and customers of the Site, such as Internet addresses. This Web Site Navigational Information is logged to help diagnose technical problems, to analyze trends, to track users' movements around the site, and to administer our Site in order to constantly improve the quality of the Site and our Service. We may also track and analyze individual usage and volume statistical information ("Aggregated Information") from our visitors and customers."

If you choose to use our referral service to tell a friend about our site, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site and register for a free trial account. e-Monitoring Services stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

Your friend may contact us at email@e-Monitoring Services.com to request that we remove this information from our database.

We post customer testimonials on our web site which may contain personally identifiable information such as the customer's name. We do obtain the customer's consent prior to posting the testimonial to post their name along with their testimonial. If a customer chooses to post personally-identifiable information to our website, it may be used by other users of the website to contact you. We are not responsible for the personally-identifiable information a user chooses to post to our website with their testimonial.

Sharing your Personal Health Information with Those you Trust

A key value of the Service is the ability to share your health information with people and services who can help you meet your health-related goals. For example, you can share health information from records you control:
  • to co-manage the health of a family member
  • to use products and services that can improve or monitor your health
  • to coordinate care provided by caregivers
  • to consult with your health care provider
If you share your information with others, you can view a list of who has access to your information and you can revoke sharing privileges at any time. When you revoke someones ability to read your health information, that party will no longer be able to read your information, but may have already seen or may retain a copy of the information.

You can share information in a health record you are custodian of with another person by sending a sharing invitation e-mail through the Service. If the person accepts your sharing invitation and has or creates a e-Monitoring Services account, you have given him or her access to that information. You can specify how long they have access (account access does not expire but, like all sharing access, it can be revoked at any time) and whether they can modify the information in the record.

You can also choose to grant administrator access to other persons, such as your spouse, for any record of which you are an administrator. Administrator access is the broadest level of access, so you should think carefully before you grant administrator access to a record. Every administrator of a record has the same access to the record, including accessing, modifying, deleting, and sharing all the information in the record.

Sharing records with other Service users

When you create an account, you become the administrator of that account. As the account administrator, you decide what level of access to grant other users of the Service. The Service creates a fixed list of each access or change by users, as well as a full history of changes to each record.

The level of access you can grant to others as an account administrator includes the ability to:

  • View data
  • Add/Change medications and events
  • Add/Change medical history
  • Add/Change contacts
  • Add journal entries
  • Add readings for charts
  • Reminders & Profile access
  • Users & Plan/Billing access
  • Upload documents

Access becomes active only when the invited user accepts the invitation. Administrator access is the highest level of access. An administrator of a health record can:

  • View data
  • Add/Change contacts
  • Add journal entries
  • Add readings for charts
  • Adjust reminder settings and profile information
  • Grant to others any level of access to the account, including administration access
  • Revoke the access of any user including other administrators, but not the owner of the account
  • Change billing information or cancel the account

Because inappropriate granting of access could allow a grantee to violate your privacy or make errors in updating your healthcare, we urge you to consider all the consequences carefully before you grant access to your records.

Information Sharing and Disclosure

e-Monitoring Services will not sell or rent your personal information, including customer e-mail addresses, to anyone.

e-Monitoring Services may hire other companies to provide limited services on our behalf, such as web site hosting; packaging, billing, answering customer questions about products and services; and sending information about our products, special offers, and other new services. If we provide personal information to such companies, we only provide the personal information they need to deliver the service. They are required to maintain the confidentiality of the information and are prohibited from using that information for any other purpose.

e-Monitoring Services may disclose and transfer the information obtained from you through this Site or the Service as part of a merger, acquisition or other sale of its assets or business.

Moreover, we may be legally obligated to disclose information to the government or to third parties under certain circumstances, such as illegal activity on our Site. e-Monitoring Services reserves the right to release personal information to its service providers, law enforcement or other government officials or in response to a formal request in a civil action, Court order or judicial proceeding as e-Monitoring Services, in our sole and absolute discretion, deems necessary or appropriate.

We may also provide Aggregated Information to third parties to improve the quality of the Service and for marketing of the Service. This aggregated information is not associated with any individual account. e-Monitoring Services does not use your individual account for marketing without first asking for, and receiving your opt-in consent.

e-Monitoring Services may use non-identifiable anonymous data that is taken from the Personal health information you provided and combine it with other anonymous data to create what is referred to as ‘aggregate data” that may be disclosed to third parties. Aggregate data is information that describes the habits, usage patterns and/or demographics of users as a group but does not reveal the identity of particular users. This data will not identify you but will be used as statistical information to determine such things as user demographics and usage patterns of our services. Aggregate data may be provided or sold to third parties. e-Monitoring Services may use this aggregate data to give potential users, providers, or business partners a picture of the e-Monitoring Services community and services.

If, at any time after registering for information or ordering the Service, you change your mind about receiving promotional information from us or about our sharing information with third parties for promotional purposes, send us a request specifying your new choice. e-Monitoring Services reserves the right to send customers certain communications relating to the Service, such as service announcements and administrative messages, that are considered part of your account, without offering you the opportunity to opt-out of receiving them.

Opt-Out Policy

If, at any time after registering for information or ordering the Service, you change your mind about receiving promotional information from us or about our sharing information with third parties for promotional purposes, send us a request specifying your new choice. Correcting & Updating Your Information

If e-Monitoring Services account owners need to change or update their registration information they may log into their e-Monitoring Services account and select "Profile" to change their email or password, and go to "Billing" to edit credit card information.

Cookies

When you interact with the Site, we try to make that experience simple and meaningful. When you visit our Site, our Web server sends a cookie to your computer. Cookies are files that Web browsers place on a computer's hard drive and are used to indicate whether you have visited the Site previously.

One of the primary purposes of cookies is to provide a convenience feature to save you time. All data collected by such third parties on behalf of e-Monitoring Services is used only to provide us with information on Site usage and is not shared with any other third parties.

The Site contains links to other web sites. e-Monitoring Services is not responsible for the privacy practices or the content of these other web sites. Customers and visitors will need to check the policy statement of these others web sites to understand their policies. Customers and visitors who access a linked site may be disclosing their private information. It is the responsibility of the user to keep such information private and confidential.

Security and Data Storage

Our Site has security measures in place to help protect against the loss, misuse, and alteration of the personal information and Data under our control. e-Monitoring Services hosts the Site in a secure server environment that uses a firewall and other industry-standard technology to help prevent interference or access from outside intruders. e-Monitoring Services also requires that unique user names and passwords must be entered each time a customer logs on to the Site. e-Monitoring Services uses SSL encryption to ensure that users' sensitive information is protected and encrypted when processing credit card transactions.

To help protect the privacy of your health information, e-Monitoring Services uploads it from your computer to the e-Monitoring Services Service only. It doesn’t transfer the information back to your computer.

When e-Monitoring Services uploads information to your e-Monitoring Services account, it sends it over the Internet using Secure Sockets Layer (SSL). This method encrypts the information to help prevent others from reading it while it's in transit from your computer to the e-Monitoring Services service.

If you're using e-Monitoring Services to upload sensitive data, you should properly secure your computer. To help do this, you can use anti-spyware and virus protection software. You can also restrict access to your computer (for example, by using a strong password for your computer login and a network firewall).

Security Alerts

In the unlikely event we discover a security breach that allowed an unauthorized to acquire information in your e-Monitoring Services account, e-Monitoring Services will notify you by sending an e-mail to the current e-mail address we have on file for your account. This e-mail address can be verified or changed in your e-Monitoring Services My Account section, under the Profile tab.

Blog Disclosure

If you use a bulletin board, blog, or chat room on this website, you should be aware that any personally identifiable information you submit there can be read, collected, or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information that you choose to submit in these forums.

Changes to this Statement

e-Monitoring Services may update this Statement at any time, so please review it frequently. If we make material changes to this Statement, we will notify you in this Statement, by email or by a notice posted on the home page of the Site.
